The business transaction and delivery are carried out exclusively in accordance with these General Terms and Conditions, based on the offers on the online store page of the VITALE TILES brand https://vitaletiles.ch. The inclusion of the customer's own terms and conditions is hereby objected to, unless otherwise agreed.

A consumer (customer) is any natural person who enters into a legal transaction for a purpose that can be attributed neither to their commercial nor their independent professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity that acts in the exercise of their independent professional or commercial activity when entering into a legal transaction.

The following terms and conditions also apply exclusively if VITALE TILES KLG (seller) carries out the delivery and service without reservation in the knowledge of conflicting or deviating terms and conditions. VITALE TILES KLG also reserves the right to refuse orders without giving reasons.

All information about the goods that the customer receives during the ordering process is non-binding. We reserve the right to make changes in design and technology that do not change or improve the functionality of the products, as well as erroneous descriptions, illustrations and price quotations. Information about promotions is only valid while stocks last.

All orders at VITALE TILES KLG require customer registration. When entering personal data for registration, the customer is responsible for providing truthful and complete information. This data will not be passed on to third parties. The confirmation of registration will be sent by e-mail immediately after sending the registration. The customer must ensure that the e-mail address provided by him for the order processing is correct, so that e-mails sent by the seller can be received at this address. In particular, when using SPAM filters, the customer must ensure that all e-mails sent by the seller can be delivered.

The customer can place the order via the online order form integrated into the seller's online store. In doing so, after entering his personal data and clicking the button finalizing the order process, the customer submits a legally binding offer of a contract with regard to the goods contained in the shopping cart. If the purchased goods are no longer desired, the seller can charge a fee for the inconvenience to the customer.

The ordered products can only be delivered to an address in Switzerland or Lichtenstein. Provided that the goods are in stock, the products will be delivered immediately after receipt of payment to the delivery address provided by the customer. The customer will receive an order confirmation by e-mail after receipt of payment. If the product is not in stock, the customer will be informed by e-mail. The liability of VITALE TILES KLG ends with the takeover of the goods by the carrier. The shipping costs are covered by VITALE TILES KLG from a certain amount. The delivery times are the working days specified in the article. In the event of delays caused by the postal service, VITALE TILES KLG reserves the right to pay for them.

If a product is no longer available after the order has been received, the customer will be informed and the item will be canceled from the order. If the customer wishes to purchase an alternative item, a new order must be placed. If the transport company returns the shipped goods to the seller because delivery to the customer was not possible, the customer bears the costs for the unsuccessful shipment.

VITALE TILES KLG grants the customer the right to return the goods within a period of 7 days from receipt of the goods if the products are defective. The goods must be checked immediately upon receipt. Complaints or returns can only be considered within the 7-day period. The customer can withdraw from the contract by returning the goods to the seller.

The prerequisite for exercising the right of return is that the returned goods are in an undamaged, unused, clean, functional and complete condition.

The customer bears the costs of the return shipment. The goods must be returned in their original, undamaged packaging and VITALE TILES KLG customer service must be contacted in writing in advance. The same rules apply to an exchange of goods.

If the goods are shipped and the buyer returns the delivery, an expense fee of 10% of the order value will be charged, which will be subtracted directly from the credit note. This fee does not apply to an exchange due to the size of the product, which is due to an error by VITALE TILES. There is no right of return for clearance items (only while stocks last), sale/discounted products, or for pre-order items that are produced specifically for an end customer.

If VITALE TILES KLG makes a wrong delivery of a product, the return postage will be refunded to the customer. For properly returned goods, no further costs that may have been incurred will be reimbursed.

All returns must be registered with VITALE TILES KLG. The return address may vary depending on the item that needs to be returned. You will receive this information when you contact VITALE TILES KLG. Returns that are not registered and confirmed by VITALE TILES KLG in advance will generate additional costs that will be charged to our external storage partner. These costs must be covered by the buyer.

For all products offered by VITALE TILES KLG, the warranty period is 12 months from the order date. In the event of a complaint / warranty claim, the manufacturer or importer will decide whether or not it is a warranty case. If the customer is responsible for the defects in the goods, for example due to careless handling, unauthorised repair attempts or incorrect installation, the guarantee does not apply.

In the event of product defects, the seller grants the customer the right to exchange the goods. The customer returns the goods at their own expense and with prior written notification to VITALE TILES KLG E-Mail.

For orders in the online store of VITALE TILES KLG, the prices listed in the offer at the time of the orders apply. The prices quoted are final prices, i.e. they include the applicable statutory value added tax. All prices are in Swiss francs.

The customer has various payment options available, which are indicated in the seller's online shop: 1. advance payment, due immediately after purchase (transfer to seller's bank account), 2. credit card, the ordered goods are always sent after the payment has been booked. The amount should be paid within a maximum of 30 days. After this period, VITALE TILES KLG reserves the right to cancel the order.

In exceptional cases, the goods can be purchased on account. This option or other payment terms can be arranged separately between the seller and the customer. The payment period is usually 10 days from the customer's receipt of the invoice. If payment is not made within 10 days of the due date, the customer will be in default and will receive a reminder by email. In the event of default, the customer may incur processing fees of CHF 100 in addition to the invoice amount.

Vitale Tiles offers customers the opportunity to receive up to four samples delivered to their home free of charge. This offer is valid once per customer. In the event of multiple sample orders, Vitale Tiles reserves the right to cancel additional orders and, if necessary, to check the customer accounts. Please note that this offer is only valid for the first sample order and is intended to help our customers make an informed decision when choosing their tiles.

If time limits are specified as working days, this includes all weekdays except Saturdays, Sundays and public holidays.

In accordance with the Swiss Data Protection Act, VITALE TILES KLG does not disclose customer data to third parties and uses customer data exclusively for regular business operations.
